Terms of Service

§ 1 — Scope

These Terms of Service ("Terms") govern all services provided by VisualMarketLab ("we", "us", "our") located at 58642 Iserlohn, Friedensstrasse 39, Germany. By engaging our services, you ("Client", "you") agree to these Terms.

§ 2 — Service Description

VisualMarketLab provides visual marketing services including but not limited to behavioral heatmap design, A/B visual testing, retail shelf simulation, consumer persona infographics, social media ad creative production, purchase pathway visualization, packaging design optimization, campaign dashboard design, and brand touchpoint audits.

§ 3 — Project Scope & Deliverables

Each service engagement is defined by the specific module selected. The scope, deliverables, timeline, and pricing are confirmed in the service configuration submitted through our contact form. Any modifications to scope require written agreement and may incur additional fees.

§ 4 — Payment Terms

  • Payment is due in full before service commencement unless otherwise agreed in writing.
  • All prices are quoted in Euros (EUR) and are exclusive of applicable VAT.
  • Late payments incur a statutory interest rate of 5 percentage points above the base rate per annum.

§ 5 — Intellectual Property

Upon full payment, all deliverables and creative assets produced by VisualMarketLab are transferred to the Client. VisualMarketLab retains the right to display completed work in its portfolio and marketing materials unless otherwise agreed.

§ 6 — Liability Limitation

VisualMarketLab's liability is limited to the total amount paid for the specific service engagement. We are not liable for indirect, consequential, or incidental damages arising from the use of deliverables.

§ 7 — Termination

Either party may terminate the service engagement with 14 days written notice. In case of termination, the Client is responsible for payment of all work completed up to the termination date.

§ 8 — Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the competent courts of Iserlohn, Germany.

Refund & Reimbursement Policy

VisualMarketLab (58642 Iserlohn, Friedensstrasse 39, Germany) strives to deliver high-quality visual marketing services. Refunds are handled on a case-by-case basis in accordance with German consumer protection law.

§ 2 — Refund Eligibility

  • Pre-service cancellation: Full refund if cancelled before service work has commenced.
  • In-progress cancellation: Partial refund proportional to work completed, calculated against the total service fee.
  • Post-delivery disputes: Refund claims must be submitted within 14 days of delivery with documented reasons for dissatisfaction.

§ 3 — Non-Refundable Items

  • Custom creative assets delivered and accepted by the Client
  • Third-party licensing fees incurred on behalf of the Client
  • Services already rendered and accepted in writing

§ 4 — Refund Process

§ 5 — Dispute Resolution

If a refund dispute cannot be resolved directly, both parties agree to seek mediation before pursuing legal action. These Terms are governed by the laws of the Federal Republic of Germany.
